Correction of Restrictive Covenants of Forest West

Know All Men by These Presents:
That Norman Enterprises, Inc., and Pamela Land Company, both being Texas corporations domiciled in Harris County, Texas, both acting herein by and through their duly authorized officers and both hereinafter referred to jointly as Developer, and
Whereas, the Developer was the Owner of a certain tract of land, to-wit: Forest West, a subdivision within the city of Houston, Texas, according to the plat filed in Volume 107, page 26 of the Map Records of Harris County, Texas, and
Whereas, the said Developer as owner thereof declared and caused to be recorded Restrictive Covenants for said tract of land, said Restrictive Covenants having been recorded in Volume 5592 Page 498 through and including page 507 of the Deed Records of Harris County, Texas to which reference is hereby made for all intents and purposes, and
Whereas, said recorded Restrictive Covenants contained the following language under General Provisions in Article 2 thereof, to-wit:

2. ENFORCEMENT. The Owner, or Owners, of land within this subdivision, the Forest West Homeowners Association, or the Architectural Control Committee may enforce these Restrictive Covenants by proceedings at law or in equity against any person or persons violating or attempting to violate any covenant either to restrain violation or to recover damages.

And specifically therein the term “Forest West Homeowners Association” is used and,

Whereas the said expression “Forest West Homeowners Association” is not defined in said Restrictive Covenants, and

Whereas the Restrictive Covenants do provide for the Forest West Community Improvement Association, specifically in Article 19 of the Residential Area Covenants, and

Whereas the expression “Forest West Homeowners Association” was a transcribing error on the part of the Developer and should have been “Forest West Community Improvement Association”.

Now Therefore the Developer hereby declares that the true and correct wording and Intent of Article 2 under the General Provisions of the Restrictive Covenants of Forest West is as follows to-wit
