BEFORE ME, the undersigned authority, on this day personally appeared Sarah Vultaggio, who, being by me duly sworn according to law, stated the following under oath:

My name is Sarah Vultaggio. I am over twenty-one (21) years of age and fully competent to make this affidavit. I have personal knowledge of all facts stated herein, and they are all true and correct.

I am the attorney for Forest West Community Improvement Association, a Texas non-profit corporation (the “Association”) and I have been authorized by the Association’s Board of Directors to sign this Affidavit.

The Association is a “property owners’ association” as defined in Section 202.001(2) and Section 204.004 of the Texas Property Code.

Attached hereto are the originals of; or true and correct copies of, the following dedicatory instruments, including known amendments or supplements thereto governing the Association, which instruments have not previously been recorded:

  1. By-Laws of Forest West Community Improvement Association;
  2. Forest West Community improvement Association Payment Plan Policy;
  3. Forest West Community Improvement Association Records Production and Copying Policy;
  4. Forest West Community Improvement Association Document Retention Policy;
  5. Forest West Community Improvement Association Management Certificate;
  6. Forest. West. Community Improvement Association Guidelines for Display of Flags;
  7. Forest West Community Improvement Association Guidelines for Rainwater Recovery Systems;
  8. Forest West Community Improvement Association Guidelines for Solar Energy Devices;
  9. Forest West Community Improvement Association Guidelines for .Roofing Materials; and
  10. Forest West Community Improvement Association Guidelines Display of Certain Religious items.

The documents attached hereto are subject to being supplemented, amended or changed by the Association.

Dedicatory instruments of the Association that have already been filed in the Real Property Records are as follows:

  1. Restrictive Covenants of Forest West filed July 20, 1964 under Volume 5592, Page 419, Clerk’s File No. B923831, and Film Code No. 013-28-0578 of the Deed Records of Harris County, Texas.
  2. Restrictive Covenants of Forest West Section Two filed October 18, 1965 under Volume 6108, Page 622, Clerk’s File No. C180858, and Film Code No. 040-22-1329 of the Deed Records of Harris County, Texas.
  3. Extension of Restrictive Covenants of Forest West recorded July 16, 2004 under County Clerk’s File No. X773632 in the Official Public Records of Real Property of Harris County, Texas.
  4. Correction of Restrictive Covenants of Forest West Addition recorded July 22, 1965, under Volume 6005, Page 60, Clerk’s File No. C128019 of the Deed Records of Harris County, Texas.
  5. Resolution Adopting a Community service Fee recorded October 12, 2010 under County Clerk’s File No. 20100438624 and Film Code No. 07-37-0379 in the Official Public Records of Real Property of Harris County, Texas.
